According to a California judge, the Trump administration’s widespread terminations of probationary staff were probably illegal. US District Judge William Alsup concluded that the Office of Personnel Management (OPM) had informed thousands of workers in a few federal departments that they were fired using power that the agency lacked.
Under no statute in the universe’s history does [OPM] have any authority whatsoever to hire and fire employees at another agency,” he stated. “They have the authority to hire and fire their staff. Additionally, they contended that only the best and most essential workers should be employed and that probationary staff are not assured jobs.
The Trump administration’s efforts to downsize the federal workforce in the name of cost-cutting have targeted government employees. Many of the workers impacted by the layoffs are probationary workers, typically those in their first or second year of employment, though occasionally they are long-time workers who have just received a promotion. Judge Alsup mandated that OPM withdraw its orders to dismiss employees at several agencies, including the Defense Department, the National Park Service, and the Department of Veterans Affairs.
